TERMS AND CONDITIONS

TERMS AND CONDITIONS FOR FOOD ORDERING SERVICE

The purpose of our mobile application (our App) is to provide a simple and convenient service to you, linking you to kiosks within a stadium and allowing you to order food and/or beverages from them.

SEAT enables customers to place orders for food and beverages (Food) on behalf of the relevant Stadium (each an Order). Depending on the relevant Stadium, a delivery option may be available (the Service).

These terms and conditions (together with the documents referred to in it) (the Terms) set out the basis upon which SEAT provides the Service. Please read these Terms carefully before placing an Order on our App. By accessing our App and placing an Order you agreed to be bound by these Terms.

If you have any questions relating to these Terms or the Service, please contact info@seat-fdc.co.uk before you place an order. If you do not accept these Terms, do not use our App.

The Service is provided by SEAT Food Delivery Company Limited (we, us or SEAT), a company incorporated and registered in England and Wales, whose registered office is at 85 Great Portland Street, First Floor, London, England W1W 7LT. Our company registration number is 1113982.

You should also read our Privacy Policy which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our App, you consent to such processing and you warrant that all data provided by you is accurate.

ORDERS

All Food is subject to availability and whilst we do our best to ensure the menus on our App are up to date, we cannot guarantee that any particular Food will be available.

When you place an Order through our App, an email thanking you for your order and confirming your Order has been received and accepted by the Stadium (the Confirmation Email) will be sent to you by us on behalf of the Stadium.

You will act on your own behalf and not for any other person when you place an Order with us. SEAT will act as agent on behalf of the Stadium when we accept your Order. The contract for the supply of any Food you Order through us will be between you and the Stadium and will only be formed when you have been sent the Confirmation Email by us. Please ensure that you have given us a correct email address as this is how we will communicate with you about your Order. If you do not collect your Order within 15 minutes of receiving a Confirmation Email, the Stadium reserves the right to discard your Food, and you will be charged for the Food.

Stadiums may use nuts in the preparation of certain Foods. Please check with the relevant Stadium prior to placing an Order if you have an allergy. SEAT cannot guarantee that any Food sold by a Stadium is free of allergens.

SALE OF ALCOHOL

Customers placing an Order for alcohol on our App must be aged 18 or over. By placing an Order that includes alcohol, you confirm that you are at least 18 years old.

Stadiums reserve the right to refuse to sell any alcohol to any person who does not appear, or cannot prove they are, aged 18 or over. Stadiums also reserve the right to refuse to deliver any alcohol to any person who is, or appears to be, under the influence of either alcohol or drugs.

CANCELLATION

If you wish to change or cancel your Order after it has been submitted and payment has been authorised, you may contact us at info@seat-fdc.co.uk and we will attempt to contact the Stadium to change/cancel your Order. However, there is no guarantee that we will be able to reach the Stadium or that the Stadium will be able to change/cancel your Order, as they may have already started processing your Order.

SEAT and the Stadium may cancel any Order and will tell you once we cancel an Order. You will not be charged for any such cancelled Orders. Any payment made prior to an Order being cancelled by SEAT or a Stadium will usually be reimbursed using the same method you used to pay for your Order. Refunds can take between 3-5 working days, or longer, depending on your card issuer or bank.

Once you receive your Order, if you are unhappy with it for any reason you should contact the Stadium in the first instance to attempt to achieve a resolution. In the event that you cannot resolve the problem, please get in touch with us as soon as possible on the same date you place the Order, so that we can contact the Stadium and attempt to achieve a resolution.

PRICE AND PAYMENT

The price of Food is listed on our App. Prices include VAT. Prices will vary between menus. Prices are liable to change at any time, but changes will not affect Orders in respect of which you have been presented with the Confirmation Email, save in the case of an obvious pricing mistake. Despite our best efforts, Food listed on our App may be incorrectly priced. The relevant Stadium will normally verify prices as part of the Order process.

Payment for Food can be made by credit or debit card through our App. Once your Order has been confirmed your credit or debit card will have been authorised and the amount marked for payment. Payment is made directly to the Stadium.

OUR LIABILITY

To the extent permitted by law, SEAT provides our Service and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of our App or the provision of the Service.

Subject as provided below, neither SEAT nor any Stadium shall have any liability to you for any direct, indirect, special or consequential losses or damages arising in contract, tort (including negligence) or otherwise arising from your use of the Service and any Order placed by you.

We expect a good standard of Food from all Stadiums, however, SEAT is not responsible for the preparation, handling or cooking of Food and this remains the sole responsibility of the relevant Stadium. SEAT is not liable for the quality of food or other goods, portion size, or any complaint arising out of the perceived status of the Food including any alleged cases of food poisoning. If you believe there has been a case of food poisoning, this should be reported to the Food Standards Agency (FSA) for investigation.

We regret that SEAT accepts no liability for, and is unable to offer refunds or compensation, based on the standard of the Food, including in cases of alleged food poisoning. However, a refund may be processed on behalf of the relevant Stadium where the payment was made through our App if the FSA determines that a case of food poisoning has occurred.

In the event that SEAT or the relevant Stadium is found to be liable to you our total aggregate liability is limited to the purchase price of the Food for the relevant Order.

This does not include or limit in any way SEAT or any Stadium's liability for any matter for which it would be illegal for us or it to exclude, or attempt to exclude, our or its liability, including liability for death or personal injury caused by negligence or for fraud or fraudulent misrepresentation.

OUR RIGHT TO VARY THESE TERMS AND CONDITIONS

SEAT may revise these Terms at any time. You are expected to check this page from time to time to take notice of any changes we make, as they are binding on you.

LAW AND JURISDICTION

These Terms and any contract formed between you and us are subject to the laws of England and Wales and the courts of England and Wales have exclusive jurisdiction over any disputes.
